Article 1 — Purpose
1.1 These terms of sale ("Terms of Sale") apply to every purchase made on beautyswapp.com, published by BEAUTYSWAPP, a French SAS with share capital of EUR 2,000, 6 rue d'Armaillé, 75017 Paris, France, Paris Trade and Companies Register No. 992 591 925, VAT No. FR44 992 591 925 ("BeautySwapp").
1.2 Customer service: hello@beautyswapp.com — +33 (0)7 69 16 47 21 — WhatsApp +33 7 56 86 53 41, Monday to Friday, 9 am to 6 pm French time (excluding public holidays).
1.3 These Terms of Sale govern the services provided by BeautySwapp (matching, trust checks, secure payment, delivery arrangements, refunds for items not as described) and the framework for sales between Sellers and Buyers. Capitalised terms are defined in the Terms of Use.
1.4 The Buyer accepts the Terms of Use and these Terms of Sale by ticking the "I accept the Terms of Use and Terms of Sale" box before being redirected to payment. The applicable version is the one in force on the date of purchase.
Article 2 — Status of the parties
2.1 Products are sold by private individuals. BeautySwapp is not the seller.
2.2 As the sale is between private individuals, the Buyer does not benefit from the right of withdrawal or the legal guarantee of conformity under the French Consumer Code. The Buyer benefits from the Seller's obligation to deliver goods as described (Article 1603 of the French Civil Code), the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code) and the "Not as described? You're refunded" guarantee (Article 8).
Article 3 — Prices and fees
3.1 The price shown on the product page is the price set by the Seller, in euros. As the Seller is a private individual, this price does not include VAT.
3.2 The following are added to the displayed price and shown separately before payment is confirmed:
BeautySwapp's service fee, equal to 10% of the product price;
a flat shipping charge of EUR 3.90 including VAT per order.
No other charge is made to the Buyer.
3.3 BeautySwapp charges the Seller a commission of 10% of the price they set, deducted from the amount paid to them. Registering and publishing Listings is free.
3.4 Example: for a product shown at EUR 10.00, the Buyer pays EUR 14.90 (EUR 10.00 price + EUR 1.00 service fee + EUR 3.90 shipping) and the Seller receives EUR 9.00 (EUR 10.00 − EUR 1.00 commission).
3.5 The service fee and commission cover trust checks, secure payment, delivery arrangements and the refund guarantee.
3.6 The new retail price and the saving shown next to the price are indicative estimates of the product's price when new in store, provided for information only.
Article 4 — Orders
4.1 The Buyer chooses a product in the catalogue and clicks "I'm buying". The Buyer ticks the "I accept the Terms of Use and Terms of Sale" box and then reaches the secure Stripe payment page, which summarises the price, service fee, shipping and total amount.
4.2 On the payment page, the Buyer enters their name, email address and telephone number and chooses the Mondial Relay Point Relais® where they wish to collect the parcel.
4.3 The sale is concluded once payment is authorised. The Buyer receives an order confirmation by email and BeautySwapp informs the Seller.
4.4 As each product is unique, it is reserved for the first Buyer whose payment is authorised. If two payments are received for the same product, the second Buyer is refunded in full.
4.5 Make an offer. The Buyer may offer a lower price by messaging BeautySwapp on WhatsApp. The Seller is free to accept, refuse or make a counter-offer. If agreed, BeautySwapp sends the Buyer a Stripe payment link at the agreed price; until payment is received, the product remains available to other Buyers. The service fee and commission are calculated on the agreed price.
4.6 If the Seller cannot ship the product, the order is cancelled and the Buyer is refunded in full.
Article 5 — Payment
5.1 Payment is made online through Stripe Payments Europe, Limited (Dublin, Ireland), an electronic money institution authorised by the Central Bank of Ireland ("Stripe"), by bank card (CB, Visa, Mastercard), Apple Pay, Google Pay. Card details are processed exclusively by Stripe; BeautySwapp has no access to them. Payments are secured by strong customer authentication (3-D Secure) where required.
5.2 Funds are held until the claim period ends (Article 8). Any payment made other than through BeautySwapp's payment page is prohibited.
5.3 The amount due to the Seller (price set by the Seller, less the commission) is paid to them by bank transfer / Stripe within 48 hours of the end of the claim period, if no claim has been made.
Article 6 — Shipping and delivery
6.1 Products are delivered by Mondial Relay to a Point Relais®, in the countries served by Mondial Relay.
6.2 BeautySwapp sends the Seller a prepaid shipping label as a QR code. The Seller packs the product carefully and drops it off at the Point Relais® of their choice within 48 hours of order confirmation; the pick-up point prints the label.
6.3 The Buyer receives the parcel's tracking number. The indicative delivery time is 3 to 5 working days after drop-off. The Buyer is notified when the parcel arrives and must collect it within the period set by Mondial Relay; otherwise, the parcel is returned to the Seller and the Buyer is refunded the price, less shipping.
6.4 In the event of loss or damage in transit, BeautySwapp handles the claim with Mondial Relay and refunds the Buyer in full once the loss or damage is established.
Article 7 — Seller's undertakings
The Seller undertakes to deliver a product that matches the Listing in every respect (brand, name, shade, size, condition, remaining quantity, dates), is genuine and is permitted by the Accepted Products Charter; to apply the hygiene protocol for swatched products; to ship within the stated time; and to cooperate in good faith in handling claims.
Article 8 — Not as described? You're refunded
8.1 The Buyer has 48 hours from receipt of the parcel to notify BeautySwapp, by email or WhatsApp, with supporting photos, of any product that does not match the Listing: condition, shade, authenticity, freshness, damaged or different product.
8.2 BeautySwapp reviews the claim and obtains the Seller's comments. If the product is found not to match the Listing, the Buyer is refunded in full, including shipping, to the original payment method within 20 days.
8.3 For hygiene reasons, a product opened or used by the Buyer after receipt cannot be refunded, unless it clearly failed to match the Listing on opening (counterfeit, expired or altered product).
8.4 If no claim is made within 48 hours, the sale is deemed accepted and the funds are paid to the Seller. The Buyer retains any statutory remedies against the Seller, in particular for hidden defects.
Article 9 — Warranty against hidden defects
The Seller is liable for hidden defects that make the product unfit for its intended use, or impair that use to such an extent that the Buyer would not have bought it, or would have paid less, had they known of them (Article 1641 of the French Civil Code). Proceedings must be brought within two years of discovering the defect (Article 1648 of the French Civil Code).
Article 10 — Right of withdrawal from BeautySwapp's services
10.1 Sales between private individuals carry no right of withdrawal (Article 2.2). A consumer does, however, have 14 days to withdraw from BeautySwapp's services (Article L.221-18 of the French Consumer Code).
10.2 As the matching service is fully performed at the time of payment, the Buyer expressly requests its immediate performance and acknowledges losing the right of withdrawal once the service has been fully performed (Article L.221-28, 1° of the French Consumer Code).
10.3 Model withdrawal form — To BEAUTYSWAPP, 6 rue d'Armaillé, 75017 Paris, France, hello@beautyswapp.com: "I hereby give notice that I withdraw from my contract for the provision of the following service: product …; paid on …; name …; address …; date …; signature (only if notified on paper)."
Article 11 — BeautySwapp's liability
As BeautySwapp is not a party to the sale, it gives no warranty on products, subject to the refund commitments in Articles 4, 6 and 8. BeautySwapp may be held liable for a proven failure in performing its own services.
Article 12 — Evidence
Payment confirmations and written exchanges (email, WhatsApp) are kept by BeautySwapp and constitute evidence between the parties.
Article 13 — Mediation and disputes
13.1 In case of difficulty, the Buyer must first send a written complaint to customer service (hello@beautyswapp.com).
13.2 If no solution is found, a consumer may refer the matter, free of charge, to BeautySwapp's consumer mediator. The referral must be made within one year of the written complaint.
13.3 These Terms of Sale are governed by French law. Failing an amicable settlement, the dispute will be brought before the competent court; a consumer may choose the court of the place where they lived when the contract was concluded or where the harmful event occurred.
