General Terms of Use

The website beautyswapp.com (the "Website") is published by BEAUTYSWAPP, a French simplified joint-stock company (SAS) with share capital of EUR 2,000, whose registered office is at 6 rue d'Armaillé, 75017 Paris, France, registered with the Paris Trade and Companies Register under number 992 591 925 ("BeautySwapp").

• User: anyone who visits the Website or uses the BeautySwapp service.

• Seller: a User, acting as a private individual, who offers one or more products for sale through BeautySwapp.

• Buyer: a User who buys, or makes an offer on, a product.

• Listing: a product page published in the Website catalogue (photos, description, price, condition, freshness information).

• Trust checks: the automated and human checks carried out by BeautySwapp before a Listing is published (Article 6).

• Monday drop: the weekly release of new Listings.

3.1 These terms of use ("Terms of Use") set out the conditions for accessing the Website and using the BeautySwapp service. Purchases and BeautySwapp's paid services are also governed by the Terms of Sale, and accepted products by the Accepted Products Charter.

3.2 Browsing the Website is free. The Seller accepts the Terms of Use, the Terms of Sale and the Charter before their first Listing is published, by a confirmation message on WhatsApp. The Buyer accepts them by ticking the "I accept the Terms of Use and Terms of Sale" box before being redirected to payment.

3.3 The Terms of Use are available at the bottom of every page and may be printed. BeautySwapp may amend them; the applicable version is the one in force on the date of the purchase or of the Listing's publication.

4.1 BeautySwapp connects private individuals who sell and buy pre-loved beauty products. BeautySwapp neither sells nor buys the products, never becomes their owner and is not a party to the sales contract, which is entered into directly between Buyer and Seller.

4.2 Sellers are private individuals. Consequently, the statutory right of withdrawal and the legal guarantee of conformity under the French Consumer Code do not apply to sales made on BeautySwapp. Buyers benefit from the protections of the French Civil Code (delivery in conformity with the contract, warranty against hidden defects) and from the "Not as described? You're refunded" guarantee set out in the Terms of Sale.

4.3 Selling on a regular basis for profit (buying to resell) is a professional activity and is not permitted on BeautySwapp. BeautySwapp may refuse products from a Seller whose activity suggests a professional nature.

4.4 The service is reserved for persons aged 18 or over.

5.1 The Seller contacts BeautySwapp via WhatsApp (the "I want to sell!" button on the Sell page).

5.2 For each product, the Seller sends real, recent photos: front, product opened if not sealed, underside showing the batch code, ingredients list. The Seller states the product's condition and how it has been stored.

5.3 Based on this information, an artificial intelligence tool drafts a proposed Listing (brand, shade, size, condition, description) and a price is suggested. The Seller reviews the Listing, corrects it if necessary and approves the price. The Seller remains solely responsible for the accuracy of the information they provide and approve.

5.4 The Listing is then checked by the BeautySwapp team (Article 6) and published in the catalogue, usually in the Monday drop.

5.5 The Seller warrants that they own the product and that it is genuine, lawfully acquired, as described in the Listing and permitted by the Accepted Products Charter. The Seller undertakes to keep the product available while the Listing is published and to tell BeautySwapp immediately if it is no longer available.

5.6 The Seller may ask for their Listing to be removed at any time, unless the product has already been bought.

6.1 Only the products and conditions permitted by the Accepted Products Charter published on the Website https://beautyswapp.com/en, which forms part of these Terms of Use, may be sold. The possible conditions are: New, sealed; New, unsealed; Swatched (fewer than 5 times); and Very good condition, within the limits set by the Charter. Any product or condition not listed in it is refused.

6.2 The following are refused whatever their condition: deodorants, sun protection and after-sun products, products for babies and children under 3, products presented as intended for pregnant or breastfeeding women, intimate hygiene products, eye-contour skincare, decanted or repackaged products, counterfeits, testers and samples marked "not for sale", expired, recalled or altered products, and products without a legible batch code.

6.3 The following are refused unless new and sealed, in particular: any opened product containing water (liquid foundations, opened creams, etc.) and any product that comes into contact with mucous membranes (mascaras, liquid eyeliners, lip glosses, lipsticks, etc.), as detailed in the Charter.

6.4 For swatched products, the Seller applies the hygiene protocol described in the Guide before shipping (top layer removed, disinfection with 70% isopropyl alcohol, drying) and removes the original applicators.

6.5 Before publication, each Listing undergoes trust checks: reading the batch code to estimate the manufacturing date and remaining freshness, reviewing the photos and declared condition, checking consistency with the Charter, and approval by a member of the team. These checks are an obligation of means (best efforts). They do not constitute authentication or certification, nor any guarantee of the product's origin, condition or safety, which remain the Seller's responsibility. The "use by" date shown on the product page is an estimate based on these checks.

6.6 BeautySwapp may refuse, amend (with the Seller's agreement) or remove any Listing that breaches the Terms of Use, the Charter or the law. The Seller is informed of the decision and the reasons for it, including where automated means were used, and may challenge it by writing to hello@beautyswapp.com (subject: "Appeal"). The request is reviewed by a member of the team.

6.7 Anyone may report a Listing they consider illegal by email to hello@beautyswapp.com (subject: "Report") or via WhatsApp, stating the address of the Listing, the reasons for the report and their name and email address. BeautySwapp acknowledges receipt, handles the report diligently and informs the person of the outcome.

7.1 Each Listing shows the Seller's first name, their status as a private individual, the product's condition, the price, the estimated new retail price and, where known, the batch code, the "use by" date and the period after opening (PAO).

7.2 BeautySwapp receives no payment to improve the ranking of a Listing. The catalogue can be filtered by category and condition. The default sort order, "Our favourites", features a selection made by the BeautySwapp team.

7.3 A Listing is removed when the product is sold, at the Seller's request, or when it no longer complies.

8.1 In respect of information provided by Sellers, BeautySwapp acts as a hosting service provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (Digital Services Act).

8.2 BeautySwapp is liable for the services it provides directly (operation of the Website, trust checks, arranging payment and delivery, handling claims) and for its own failings.

8.3 Pre-loved products are sold without any manufacturer's warranty and are intended for external use on healthy, unbroken, non-irritated skin. Buyers are advised to check the ingredients list and carry out a patch test before first use. Products sold on BeautySwapp are not intended for pregnant or breastfeeding women or for children under three.

8.4 BeautySwapp endeavours to keep the Website available without interruption but cannot guarantee it.

In particular, Users must not: complete outside BeautySwapp a sale initiated on the Website; pay or be paid other than through BeautySwapp's payment link; publish or send misleading, abusive or discriminatory content; collect other Users' data; scrape the Website; or make clearly abusive offers.

10.1 The Website and its elements (the BeautySwapp trade mark, logos, text, visuals, database) belong to BeautySwapp or are used with permission. Any unauthorised reproduction is prohibited.

10.2 The Seller grants BeautySwapp a free, non-exclusive, worldwide licence, for the duration of the Listing plus 2 years, to reproduce, adapt (cropping, background removal, light retouching, translation) and publish their product photos and information on the Website and in BeautySwapp's communications (social media, newsletter, advertising), to operate and promote the service. The Seller warrants that they hold the necessary rights.

10.3 Product trade marks belong to their owners; they are mentioned solely to identify the products being resold.

BeautySwapp's processing of personal data is described in the Privacy Policy.

12.1 Occasional sales of personal second-hand goods are in principle exempt from French income tax. Information on sellers' tax and social security obligations is available at impots.gouv.fr and urssaf.fr.

12.2 Under Articles 1649 ter A et seq. of the French General Tax Code (DAC7 Directive), BeautySwapp reports annually to the tax authorities Sellers who made at least 30 sales or at least EUR 2,000 in sales in the calendar year, and sends them a copy of the information reported. For this purpose, the Seller provides, on request, their surname, first name, date of birth, address, tax identification number and payment details.

13.1 These Terms of Use are governed by French law.

13.2 In the event of a dispute, the User must first send a written complaint to hello@beautyswapp.com. If no amicable solution is found, a consumer may refer the matter, free of charge, to the consumer mediator named in the Terms of Sale.

13.3 Failing agreement, the dispute will be brought before the competent court; a consumer may choose the court of the place where they lived when the contract was concluded or where the harmful event occurred.
